Do you know if WOM can be filed only when the PD is current. After reading this article i feel so.
PD has no effect on filing a civil action as visa bulleting is changing every month. My friend in Oregon got I-485 approval after filing Wom even though his PD is not current on the latest visa bulletin.

* AILA has reported the DOS advised AILA that "thanks? to" the decrease in demand for EB visa numbers from USCIS I-485 cases and 245(i) labor cases still being held in the Department of Labor, the visa number would progress forward as follows:

It's funny how many types of personalities you see in everyday life. I remember in my early childhood days there always use to be one guy at the least in my class who would do things that would freak everybody out....usually he would be the teacher's cutest student. 1. In the draft letter to president, the line "Reinstate premium processing of
Immigrant Petitions." is a bit ambigous and dosent specify which petition.
Shouldnt it read "Reinstate premium processing of I-140 Immigrant Petitions."
2. Also shouldnt the goals be in the order of ease of acheivability. Many of the
more difficult (though more powerful) goals are at the top wheras items like
reinstating I-140 premium proessing are at the bottom.
What do you folks think..?

In essence what the memo seems to state is that I can have another employer file an I-140 petition, and if approved, simply substitute the I-140 in my existing I-485.
Is that right?

I believe you can do interafiling if you have two approved i140 from the same employer and you have a pending 485 and the later 140's PD is current.

DOS cannot move that further (years) under the quota. Jan. 2007 could be the max DOS can move in May bulletin
As all filings after May CIS receive won't get be processed/approved until October (2012 fiscal year), June bulletin will be interesting. The only new demand (EB2 porting as mentioned), EB1, EB2 ROW, and EB2 I/C who missed 07/2007 and get current (say 01/2007) will be an interesting number CIS has to come up with to tell DOS (assuming all those approved).
After May, DOS will then have a full picture of all demand for the June/July/August/September for EB1 EB2ROW EB2 I/C. They will consider denial rate/RFEs/manpower (CIS can only handle specific amount) to decide how to distribute those visa numbers. I would say, they will try to use as much as possible in July before August (as mostly fine tuning to match 140K)
Still, I think, if things don't change, EB2 I/C PD

AP can be used to re-enter and you can continue on your H1 if it is valid. Your H1 is invalidated only if you use EAD.
I just came back to US using AP, I had booked an appointment for Visa interview. But after seeing the PIMS mess I decided to use AP. It was very smooth and easy.

So EB3-ROW is retrogressed bcoz it doesn't get any spillover and hence it affect EB3-I.
So where is the correct interpretation? Does any body know?

This means each employment catagories are seperatly free from country quota if demand is less than supply in each catagory. If you analyze word by word in the language of the AC21 act, you will understand. Unfortunally (fortunatly for EB3) DOS has not interpreted the law correctly till 2006. Now they are interpreting correctly.

We have plans of visiting Canada in November. My card had a data entry error because of which I have to apply for a replacement card. It can take 3 months for that.
As I have no other proof of permanent residency (as I have to return the card with error), alternative is to get the I-551 stamp on the passport that is valid for 1 year. It works as a short term replacement of the acutal card.
What is this I-551 stamp ? Is stamping that mandatory ? What kind of documents do you need while you go for this stamping ?
If one does not plan on travelling until we receive the physical Green Card - would we still have to do this stamping ?
As I have no other proof of permanent residency (as I have to return the card with error), alternative is to get the I-551 stamp on the passport that is valid for 1 year. It works as a short term replacement of the acutal card.

Hey BP, taking your numbers and assuming horizontal spill over instead of vertical would make eb2 all over current. total spill over from eb1 = 53807, total eb2 quota = 40040, pending eb2 = 74932
assume eb1 demand = 5000, eb2 demand = 20000
we can easily see eb2 getting completely approved.

But seems to be just laid on table and waiting for action. Specially S.1033/H.R.2330 and S.1916-1919 has a provision to exempt the immidiate family members from Employment based visa numbers which is Good.

I had soft LUD's yesterday (9/19) on all I-485 applications in my family and on the (July 2007) EAD's for my spouse and me. My PD is May-30 2006, so I'm wondering if they are looking at low-hanging fruit for the next month (or to hang the fruit!)
Did anyone see any Soft LUDs on their 485 or old EADs before their approvals/RFEs?
My PD is June 7 2006, not current. Yesterday, I had a soft LUD on my 485 and my first EAD. These two haven't seen any activity since early 2009, and I'm wondering if this means anything or if I'm reading into this a little too much.

As I said before, I am never going to fly thru UK, even though I sill have a transit visa valid till Nov 2008. I can still feel the pain.
Last time I had travelled by British Airways in 2004 and I have made a resoultion for never tavelling with them again. We had a baby 2 years old and he was cranky and my wife asked airhostess to clean the feeder and she refused, saying that 'Mam we don't do this!'. Point is that they don't treat us well even though they get lot of income on routes to India. Also, look at those crappy old planes they deploy on these routes. As someone else said in this thread that it is time for Indian Govt. to wake up and be stiff on such lapses. I am sure they will listen, as they can't afford to lose big bucks coming from India anymore.

I just wanted to let you all know that in the firm that I work ( a fortune 10 company) job postings clearly require " unrestricted authorization to work in USA without sponsorship".
I know that they have used this logic to screen out candidates who require sponsorship visas. EAD (for dependent) can be percieved as unrestricted work authorization for 1 year (or restricted because it ends in 1 year). EAD for primary applicant is restrictive on the applicant (because of the same/ similar job requirement)..

I am planning to take up a EB3 labor substitution case, and I have a few questions.
With the I140 premium processing being eliminated from today, and the current I140 processing time taking 9 months my question to you all is:
a. Suppose I apply for my I140, I485, AP today (say May 18th 2007), will I be eligible to get an EAD in the next 90 days, though my I140 could still be pending.
b. Will the time for AC21 portability start from the day I applied for I485 or from the day the I140 will get approved.
c. Suppose me and spouse get the EAD (despite I140 pending), and spouse converts from H4 to EAD while I stay on H1-B, what happens to the spouse status in case the I140 gets denied.
d. What is the possibility of the EB2 VISA dates moving further.

You seem pretty confident about getting an RFE. Did you already see the online status changed and just waiting for it to arrive in the mail OR is this pure guess work?
The reason I ask is because I am also in the middle of changing jobs and so have the same concern but not very confident of receiving one.
My priority date is current since september 2010.
My H1B transfer application is with USCIS since Aug 27th, 2010. The date for transfer requested is Novemebr 1st, 2010.
My I 485 was filed in Aug 2008. I have been working with the current sponsoring employer since 2005, no breaks.

This looks from murthy and contradicts with what Ron Gotcher mentioned on his website.

Free calls sounds good ....
I am using mother india calling cards currently....
they are 2 cents a minute I believe...
a 10$ charge gives me 500 minutes...
so for $25 I get 1250 minutes which is around 20 hours....
I guess I can stick to this for now and wait for feedback from folks here to see if Vonage is really that good....
I doubt I will talk more than 20 hours in a month.

Anyways the fact of the matter is that we are in a limbo, all indications point to Obama becoming the next president of US. if CIR 2008 was any indication , we as EB applicants are royally screwed if Sen Durbin dictates his immigration policy. Hi All,
I got the I-485 approval/welcome notice from USCIS for myself and my spouse today. But the wierd thing is that my NSC online status still shows RFE response received and case pending (from 2008)...the welcome notice says I should expect to receive the card in 3 weeks...guess I am greened.
Anyone else face a similar situation?

Is the end of the three year period considered when you applied for LC, or when you apply for 485/140? Since, technically, people who are pending at the BEC as well as those who are affected by retrogression are still on NIV, and have not applied for immigrant Visa yet.
This point will have an impact on a lot of folks who may have applied for LC less than three years after getting their Degree but would have crossed that limit by the time they can apply for the immigrant Visa.

Hi friends,
My husband and me work for the same company now. He applied in EB3 (India) and PD date with December 2006. I-140 approved and I-485 applied in July 2007. Got EAD and AP for both but still working on H1B (Not used EAD and AP).
From other company, in 2007, I applied for labor substitution and it is approved yesterday, which has PD Nov 2004 (EB3 - India). One of my friend working for this company and I got the reference last moment and I was not hoping for this approval.
Now I have to switch to this company as the company management are asking me to join the company. I read many threads in this forum and this thread too about multiple filings of I485s and withdraw one while applying other.
I read some people had no problems with multiple I-485s. But Murthy's advice is against this while others like Rajiv in favour of this.
Please advice me what could be the best in my case.
I have PG in engineering (CS) from India.

We may be talking about the same thing...I believe that ALIA as asked USCIS for clarificatin about spouses both filing (my wife and I both have.) Only I have no EADs or AP on my application. Just straight 485. My wife's 485 has EADs, APs, for both of us. Now both of our lawyers said it would be fine. It is not about what USCIS wants, however--it is about what they will lose court cases over. They can't possibly dissallow multiple applications after the fact, after we've paid for them. If USCIS was going to x-nay this, their window of opportunity is over. By not barring it, they've defacto allowed it.

My intentions was not to offend anyone...all I am trying to say is blaming the H4 visa is unfair...H4's intention is to have the dependents be able to join the H1 visa holder....just that, nothing more....it is another story that most people want to do more than just that while on a H4. And for that several other visa options are all open..

OK I will help in the research.. but this is what I have seen.. all the lawyers are just advising or strongly advising.. no one has metioned why one should NOT do multiple applications, the only reason I have heard so far is that multiple applications (4 - if both the spouses apply for each other as dependents) may cause confusion in allocating the A# and that may lead to problems and complications and eventual delays....
but both me and my wife already have A#'s so does that mean that there wont be any confusion as uscis need not allot A#'s for us.....
jeez.. man ... some one should know better......
anyways I will do more research and pm you if I find any more information apart from what I have stated above.

I think the thread is perfectly valid and we should go for it. If someone has paid income taxes to US for 10 years, it is no mean thing. 10 years represent typcially about 25% of his/her earning life. After spending substantial percentage of one's life living in, and making contributions to, US, especially in his/her youth, the guy is more naturalised except that he does not have a citizenship card. Now how many of these guys will be able to slip back in to their own country to readjust their lives with american born and american grown kids.
I think it is not only reasonable but also humane for the government to consider the plight of such people and issue citizenship. The yardstick for qualification will have to be worked out, but Saralayar listed some of the valid parameters like
- 10 years working in US (legally)
- 40 points in social security
- no criminal record
If I may share my thoughts on yardstick, it would be like this
- 7 years of legal residence, contributions to SSN, and taxes should provide provisional GC
- 10 years of legal residence, contributions to SSN, and taxes should provide citizenship
- 7 years of legal residence post approved I-140 should provide citizenship
Most of us in this forum must have already contributed over 75K-100K to IRS over the years. I strongly believe that the govt owes more than an obligation to take care of the interests of this skilled group.

I am on a h1b currently. I changed empoyers in the US but the old stamp is still valid till semptember 2008. I has taken a visa date for jan30 in mumbai consulate and was going to fly back on feb9. Now planning to cancel the visa stamping because of the PIMS delays. I hope i am still valid to fly as i have a valid visa stamp and a new petition from current employer too which i can show at port of entry. Do let me know your views on the same and if there are any probable issues....

It's always a good practice to take a receipt notice of any action done by your lawyer & keep that for your records.
When you apply for EAD, soon USCIS will ask you to do fingerprints(BIO-2). I think you missed that part and it might be denied or void as it was left for so long!
You can file for new EAD online at https://efiling.uscis.dhs.gov/efile/InteractionMgr?interactionmgr.interaction=SetupEfo rms×tamp=1127234762990
Create your account & you can file your self with out lawyer's assistance. It's always suggested to file EAD(I-765) & AP(I-131) jointly. You can pay by credit card.
(1) After applying online, you will receive 'Receipt notices' of EAD & AP.
(2) Now a days USCIS will set up an apointment for BIO-2 of EAD.
(3) You have to send supportive documents for Advance Parole, like photos,brief explanation of qualifying for AP...I can give you those sample formats !
Coming to I-485 BIOMETRICS, call USCIS & ask them about BIO. Go to this website & register https://egov.immigration.gov/cris/jsps/index.jsp. You must add I-485,EAD,AP & I-140 receipt numbers like LINXXXX and you will get emails when they get approved. You can also see the changes on 'LAST UPDATED' column, which means your case is touched by an officer. But it's not the confirmation of approval until status message has changed or you got an email.

My lawyer filed for my EAD in April 2005. I have been working on H1 all the time and i was not aware that he filed for my EAD.
HE filed for my AP at the same time and i got it. When i asked him about EAD , he said its not required and that he did not file it.
Yesterday he mailed me a set of copies in which i found receipt notice for EAD.I checked the status and it says that my case is pending since April 2005.
There was no request for any proof or anything. It just says we mailed you notice of action and the case is pending.
I need EAD now. What should i do?
I called the USCIS and they said that it is out of processing time and filed a service request.
All my friends who filed their I-485 recently got their Biometrics notice and i didn't get any. Whats wrong with my case?
I am confused , what am i supposed to do?

When you apply for EAD, soon USCIS will ask you to do fingerprints(BIO-2). I think you missed that part and it might be denied or void as it was left for so long!
You can file for new EAD online at https://efiling.uscis.dhs.gov/efile/InteractionMgr?interactionmgr.interaction=SetupEfo rms×tamp=1127234762990
Create your account & you can file your self with out lawyer's assistance. It's always suggested to file EAD(I-765) & AP(I-131) jointly. You can pay by credit card.
(1) After applying online, you will receive 'Receipt notices' of EAD & AP.
(2) Now a days USCIS will set up an apointment for BIO-2 of EAD.
(3) You have to send supportive documents for Advance Parole, like photos,brief explanation of qualifying for AP...I can give you those sample formats !
Coming to I-485 BIOMETRICS, call USCIS & ask them about BIO. Go to this website & register https://egov.immigration.gov/cris/jsps/index.jsp. You must add I-485,EAD,AP & I-140 receipt numbers like LINXXXX and you will get emails when they get approved. You can also see the changes on 'LAST UPDATED' column, which means your case is touched by an officer. But it's not the confirmation of approval until status message has changed or you got an email.

Got the CPO ordered email on 09/16/2010, updated to Post Decision Activity on 09/17/2010 for both primary and derivative.
Got FP appointment scheduled in the first week of Sep, but gave it earlier ( last week of august)
No SR, No Infopass.

I'm wondering if these figures actually provide ammo for people who claim that H1b is driving down salary. A $50k median starting and a $60k median is not that great.

Here is another case of a person I came across recently. This person was stuck for the past 5 years in Namechecks . He applied for GC in 2001. He got his GC just recently after a long wait and struggle.
That's a shame. But now he is free to enjoy his life and not think 485 updates.Congratulations to him :)

I always thought, the system was fair, it was only the overwhelming numbers of immigrants from certain countries that made it look unfair....but the closer I get to the stage where DOS decisions start impacting me, the more I realize that the system is not fair at all. The game of visa numbers and allocations is driven by white house politics alone...DOS being the spokesperson for the politics. Essentially the white house is directly throttling immigration through the DOS...on its own whims and fancy.
I wouldn't say they are cruel, but they are certainly selfish..and are bent on sucking the blood of would be immigrants/working non-immigrants...the best way to prevent this from happening is to not come here....let the Indians/Chinese completely stop coming here on H1s/L1s and then we'll see how far can America fly...
So, what made you import yourself here? You could have stayed back in your own country..by the way, coming on a H4 was a choice..it wasn't forced upon you...didn't you know before coming here that you would have to stay home on a H4? H4->F1, H4->H1...all these options are always open to you..
America will fly even higher with or without India and chinese those days are gone, look into the future. In the past not many american used to take science and Technology filed but now its different.

This is true. Lingo customer service is bad. Now I am stuck with them for 2 years. Rep was rude. Talked to the supervisor. Even he was rude. Asked him to pass me on to his manager. He refused to directly transfer to his manager.
I am even thinking of paying $100 cancellation fee and get off their service.
I am happy that Vonage came up with a good plan.
I don;t mind paying some bucks more for quality service.

I spoke to IO this morning regarding NC clearance for my family (7/2 filers). I was told whereas, my derivative's (wife and daughter) names have been cleared but there is no information on my clearance. She furthur told me the names were submitted on 8/30/07 and was told to wait for another month or so.
Guys: What is your take on this? I have started worrying now. Although they say 120 day processing time- My understanding is you are either cleared in few days or get stuck in the hole.
Ladies ( usually derivatives ) gets cleared fast and male lions will be "stuck for years"
